Terms of Use

These Terms of Use ("Terms") govern your use of the Nuː application ("the App") provided by Enie Studio ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices you own or control for your personal and commercial use.

2. Restrictions

You agree NOT to:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, lend, sell, or redistribute the App
• Remove or alter any proprietary notices from the App
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the App's functionality

3. Your Content

Ownership

You retain all rights to the templates and files you create, store, or manage using the App. We do not claim any ownership or rights to your content.

Responsibility

You are solely responsible for:

• The content of your templates
• Backing up your data
• Compliance with applicable laws regarding your content
• Any consequences of creating, storing, or sharing your templates

4. Privacy and Data

Your use of the App is subject to our Privacy Policy. By using the App, you acknowledge that:

• We do not collect, store, or transmit your personal data
• Your templates remain on your device or your personal iCloud account
• You control all data storage and sync settings

5. Updates and Changes

We may:

• Release updates, patches, or new versions of the App
• Discontinue support for older versions
• Add, modify, or remove features
• Change these Terms at any time

Continued use of the App after changes constitutes acceptance of the modified Terms.

6. Apple App Store

The App is distributed through the Apple App Store. You acknowledge that:

• These Terms are between you and us, not Apple
• Apple has no obligation to provide support for the App
• Apple is not responsible for the App or its content
• You must comply with Apple's App Store Terms of Service
• Apple and its subsidiaries are third-party beneficiaries of these Terms

7. System Requirements

System requirements for each app are listed on its respective App Store page. You are responsible for ensuring your device meets these requirements before purchasing or downloading.

Some apps may require an iCloud account for optional sync features.

8. Disclaimers

AS-IS Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Merchantability and fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation
• Accuracy or reliability of results

Data Loss

While we strive to help you manage your templates safely, we are not responsible for any data loss. You should maintain regular backups of your important files.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, use, or goodwill
• Service interruptions or security breaches
• Any damages exceeding the amount you paid for the App

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your content created or stored using the App

11. Termination

We may terminate or suspend your license at any time if you violate these Terms. Upon termination:

• You must stop using the App
• You must delete all copies of the App
• Your data remains yours (locally or in iCloud)
• No refunds will be provided

12. Refund Policy

All purchases are handled by Apple through the App Store. For refund requests, please contact Apple Support directly. We do not process refunds.

13. Governing Law

These Terms are governed by the laws of Germany, without regard to conflict of law principles.

For European users: You may also have rights under EU consumer protection law.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
